How L-1 Visa Holders Can Self-Petition for a Green Card
If you hold an L-1 visa — whether L-1A (managers/executives) or L-1B (specialized knowledge) — you are on a visa with a hard expiration. L-1A holders have a seven-year maximum. L-1B holders have five years. When that time runs out, your options through your employer may be limited.
The EB-2 National Interest Waiver changes that equation. It is a self-petition for a permanent green card that does not require your employer's involvement, endorsement, or even knowledge.
Why L-1 Holders Are Strong NIW Candidates
L-1 visa holders are, by definition, professionals with specialized knowledge or managerial experience at multinational companies. That profile — years of technical expertise, cross-border project leadership, specialized industry knowledge — maps well to the NIW framework.
The NIW requires demonstrating that your work advances a U.S. national priority. If you work in energy, technology, healthcare, or manufacturing, your L-1 experience often provides exactly the kind of documented contributions the NIW demands: technical leadership, knowledge transfer, and industry-specific expertise that benefits U.S. economic competitiveness.
The L-1 to NIW Path
- No employer involvement. Your company does not need to sponsor, approve, or even know about your NIW petition.
- No job offer required. The NIW waives the labor certification and job offer requirements entirely.
- File while on L-1. You can begin the NIW process while maintaining your current L-1 status.
- Concurrent filing. Depending on your priority date, you may be able to file the I-485 adjustment of status concurrently with your I-140.
