H-1B Sixth Year Approaching? What Energy Engineers Must Know
If you are an engineer in the energy sector and your H-1B is approaching its sixth year, your clock is running. This post explains your options — specifically the one that removes the clock entirely.
The H-1B visa has a six-year maximum. Extensions beyond six years are possible only if certain conditions are met — typically, a PERM labor certification or I-140 petition must be pending or approved. But those pathways keep you dependent on your employer.
The EB-2 National Interest Waiver offers a different path. It is a self-petition. Your employer is not involved. You file independently, based on the national importance of your energy-sector contributions. And once your I-140 is approved, you can extend your H-1B beyond the sixth year indefinitely while your green card is processed.
Why the Sixth Year Creates Urgency — Not Panic
The deadline is real, but it does not eliminate your options. What it does is compress your timeline. The NIW processing timeline starts when you file, not when you begin thinking about it. Premium processing for the I-140 petition is available and can reduce that phase to 15 business days.
If you file your NIW and receive an approved I-140 before your sixth year expires, you can extend your H-1B in one-year or three-year increments. The clock stops being a constraint.
